The specific terms of your financing will be set forth in a separate financing agreement that you must review and sign before funds are disbursed. The financing agreement, not these Terms, governs your repayment obligations. These Terms govern your use of our website and services generally.
Revenue-based financing products offered through Fast Funds Capital are not loans. They constitute a purchase of future receivables, and repayment is made through agreed-upon remittances from business revenue. These products are subject to separate merchant agreements. You acknowledge that revenue-based financing differs from traditional lending and should not be construed as a loan product.

Our total liability to you for any claim arising out of or relating to these Terms or your use of our Services shall not exceed the total amount you have paid to us (if any) in the twelve (12) months preceding the event giving rise to liability, or one hundred dollars ($100), whichever is greater.
You agree to indemnify, defend, and hold harmless Fast Funds Capital and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If the parties cannot resolve the dispute within thirty (30) days, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with the seat of arbitration in New York, New York.
We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. All provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.
